Die IU Group N.V., Square Ambiorix 10,1000 Brüssel, Belgien, verarbeitet Ihre personenbezogenen Daten themenbezogen in gemeinsamer Verantwortlichkeit mit weiteren konzernangehörigen Gesellschaften (alle geschäftsansässig Mülheimer Straße 38, 53604 Bad Honnef, sofern nicht anders angegeben). Tätigkeiten im Zusammenhang mit dem Betrieb der IU Internationale Hochschule erfolgen in gemeinsamer Verantwortlichkeit mit der IU Internationale Hochschule GmbH, Juri-Gagarin-Ring 152, 99084 Erfurt („IU“), auch im Hinblick auf deren Studien- und Weiterbildungsangebote einschließlich Kontaktaufnahme und Zusendung von Informationen.

Für zentrale Services im Konzern wie Controlling-, Rechnungswesens- und Personalverwaltung, Office-, Prozess- und Qualitätsmanagement, Einkauf und Verkauf sowie zentrale Dienstleistungen bedienen sich die vorstehend genannten Gesellschaften der Unterstützung der IU Corporate Services GmbH, die zusätzlich verantwortlich für die Datenverarbeitung ist; IU IT Services GmbH, Ridlerstr. 57, c/o IU Group N.V., 80339 München, in Bezug auf die Bereitstellung der betrieblichen IT-Infrastruktur einschließlich Hardware und Software, Telekommunikation und elektronischer Kommunikation; IU Examination Service GmbH für Serviceleistungen im Bereich der Prüfungsaufsicht; IU Marketing Service GmbH sowie IU Sales Services GmbH, Ridlerstr. 57, c/o IU Group N.V., 80339 München, für Dienstleistungen im Bereich Marketing und Vertrieb (hierzu zählt auch die Vermarktung über die Website und ggf. der Betrieb des Bewerberportals für Studierende); IU Commercial 1 GmbH für die Leitung des Online-Campus und IU Commercial 2 GmbH für die Leitung der Campus Standorte und im Hinblick auf die Campusprogramme; IU Student Services GmbH zusammen mit der jeweiligen GmbH, die für den jeweiligen Standort besteht und nach ihrem Städtenamen benannt ist, z.B. IU Dortmund GmbH oder IU Bonn GmbH, zur Betreuung von (Studien-)interessierten, Studierenden und Teilnehmenden, insbesondere Studien- und Weiterbildungsberatung, sowie IU Service GmbH für den Betrieb von Gaststätten und Wohnheimen.

Zweck der Verarbeitung

Ihre personenbezogenen Daten werden für folgende Zwecke verarbeitet:

• Teilnehmendenverwaltung, einschließlich Verwaltung Ihrer Anmeldung, Durchführung des Fernunterrichtsprogramms, Ausstellen von Ausweisen und ähnlichen Dokumenten, Festsetzung und Einzug von Programmgebühren, erforderlichenfalls An- und Abwesenheitskontrolle, Organisation des Lehrbetriebs (online, virtuelle Veranstaltungen und Präsenzveranstaltungen), Anmeldung und Teilnahme an Lehrveranstaltungen, Bereitstellen und Verteilen von Lehrmaterial, Entgegennahme und Verteilung von Prüfungsleistungen einschließlich Plagiatsprüfungen, Durchführung von Prüfungen und Ausstellen von Prüfungsbescheinigungen oder Zeugnissen bzw. Teilnahmebescheinigungen, sonstige allgemeine Verwaltungs- und Personalprozesse, die zur ordnungsgemäßen Abwicklung des Lehrbetriebs erforderlich sind;
• Teilnehmendenbetreuung einschließlich Gesprächsangebote;
• Führen gesetzlich vorgesehener Aufzeichnungen, einschließlich Buchführung;
• interne und externe Revision;
• Buchung, Durchführung und Abrechnung etwaiger Leistungen;
• Erfüllung gesetzlicher Mitteilungs- und Meldepflichten;
• Bereitstellung der betrieblichen IT-Infrastruktur einschließlich Hardware und Software, Telekommunikation und elektronischer Kommunikation, einschließlich des Internets, mobiler Anwendungen, Fernwartungszugriff, Online-Meetings, sonstige technische Einrichtungen für den Lehrbetrieb und das Lernen und Ablegen von Prüfungen mittels Software, Lizenzvergabe und Lizenzkontrolle, Zuweisung von Benutzerrechten, Debugging und Troubleshooting, Betrieb einer Firewall und ähnlichen Sicherheitseinrichtungen, URL- und Malware-Filterung sowie Malware-Reporting, Tracking von auf Wechselmedien kopierten Dateien, Ticketsystem für Anfragen und Helpdesk, Einsatz von IT-Sicherheitssoftware und Überwachung der rechtmäßigen Nutzung im zulässigen Maß;
• interne Audits zur Einhaltung gesetzlicher, aufsichtsrechtlicher und anderer Unternehmensführungspflichten und interner Richtlinien, im Falle des Verdachts von Straftaten oder Ordnungswidrigkeiten zur Aufdeckung dieser einschließlich der Untersuchung von Compliance-Verstößen.
  

Rechtsgrundlage für die Verarbeitung

Ihre personenbezogenen Daten werden auf Basis von Art. 6 Abs. 1 b) Datenschutz-Grundverordnung („DS-GVO“) zur Durchführung des Fernunterrichtsvertrags mit Ihnen verarbeitet. Soweit wir gehalten sind, Ihre personenbezogenen Daten zur Erfüllung einer gesetzlichen Verpflichtung zu verarbeiten, erfolgt dies auf der Grundlage von Art. 6 Abs. 1 c) DS-GVO, oder in Fällen, in denen wir Ihre personenbezogenen Daten an eine andere Konzerngesellschaft oder an andere Empfänger für die von uns oder einem Dritten verfolgten legitimen Interessen übertragen, werden wir dies auf Basis und in Übereinstimmung mit Art. 6 Abs. 1 f) DS-GVO vornehmen, um gemeinsame betriebliche Infrastruktur, z.B. IT-Systeme, oder Online-Tools für den Lehrbetrieb und Prüfungen, einschließlich der Plagiatskontrolle zu nutzen.

In Ausnahmefällen, in denen die Verarbeitung Ihrer personenbezogenen Daten nicht erforderlich ist, um das Fernunterrichtsverhältnis mit Ihnen durchzuführen, wir Ihnen aber eine entsprechende Verarbeitung vorschlagen möchten, werden wir Sie gesondert um Ihre Einwilligung gem. Art. 6 Abs. 1 a) DS-GVO bitten. Nähere Informationen erhalten Sie dann in diesem Zusammenhang.

Empfänger

Zu Ihren personenbezogenen Daten haben Mitarbeitende und Lehrpersonal der jeweiligen IU-Gesellschaft Zugriff, die mit Tätigkeiten betraut sind, die im Abschnitt ‚Zweck der Verarbeitung‘ beschrieben sind.

Darüber hinaus erbringen ggf. unsere Konzerngesellschaften IT-Dienstleistungen für uns. Eine Übersicht über die Konzerngesellschaften senden wir Ihnen gerne zu. Mitarbeitende dieser Firmen haben ggf. in dem zur Aufgabenerfüllung erforderlichen Maß Zugang zu Ihren personenbezogenen Daten. Des Weiteren bedienen wir uns der Hilfe verschiedener externer Dienstleister zum Betrieb unserer IT-Infrastruktur einschließlich der elektronischen Kommunikation, dem Betrieb unserer Websites sowie der Verwaltung.

Wenn Sie sich für eine Zahlung über Stripe entscheiden, erfolgt die Zahlungsabwicklung über die Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Irland. Wir übermittlen an Stripe die im Rahmen des Bestellvorgangs mitgeteilten Informationen sowie Name, Anschrift, Kontonummer, Bankleitzahl, ggf. Kreditkartennummer, Rechnungsbetrag, Währung und Transaktionsnummer.

Die Datenverarbeitung erfolgt auf Basis von Art. 6 Abs. 1 S. 1 lit. b) DS-GVO. Die Datenübermittlung erfolgt allein zum Zweck der Zahlungsabwicklung; die Daten werden nach erfolgter Zustellung wieder gelöscht, insofern unsere Dienstleister nicht selbst aus gesetzlichen Gründen zur Aufbewahrung der Daten verpflichtet sind. Stripe verarbeitet Ihre personenbezogenen Daten gemäß dem Vertrag, den Sie mit Stripe abgeschlossen haben. Wenn Sie sich für eine Zahlung über PayPal entscheiden, erfolgt die Zahlungsabwicklung über PayPal (Europe) S.à.r.l. & Cie. S.C.A., 22-24 Boulevard Royal, 2449 Luxembourg. Wir übermitteln an PayPal Name, Adresse, E-Mail-Adresse, Telefon- und Mobilnummer, IP-Adresse. Die Datenverarbeitung erfolgt auf Basis von Art. 6 Abs. 1 S. 1 lit. b) DS-GVO. Rechtsgrundlage für die Datenverarbeitung ist Art. 6 Abs. 1 S. 1 lit. b) DSGVO, da die Verarbeitung der Daten für die Bezahlung mit PayPal und damit für die Durchführung des Vertrages erforderlich ist. Die Datenübermittlung erfolgt allein zum Zweck der Zahlungsabwicklung; die Daten werden nach erfolgter Zustellung wieder gelöscht, insofern unsere Dienstleister nicht selbst aus gesetzlichen Gründen zur Aufbewahrung der Daten verpflichtet sind.

PayPal verarbeitet Ihre personenbezogenen Daten gemäß dem Vertrag, den Sie mit PayPal abgeschlossen haben. PayPal gibt Ihre Daten möglicherweise auch an Dritte weiter, soweit dies zur Erfüllung der vertraglichen Verpflichtungen erforderlich ist oder die Daten im Auftrag verarbeitet werden sollen. Des Weiteren können Ihre personenbezogenen Daten zum Zwecke des Einzugs fälliger Forderungen an einen Inkassodienstleister, namentlich die Creditreform Bonn Domschke & Rossen KG, weitergeleitet werden.

Im Rahmen Ihrer Bewerbung und der Durchführung Ihres Fernunterrichtsvertrags ist es notwendig, dass die IU Group Ihre personenbezogenen Daten verarbeitet. Zur Verarbeitung und Verwaltung Ihrer Daten nutzen wir verschiedene Funktionen von externen Anbietern (namentlich Frankenraster GmbH und d.velop AG), welche Kenntnis über Ihre personenbezogenen Daten erhalten. Folgende Datenkategorien können davon betroffen sein: Name, Anschrift, Telefonnummer, E-Mail-Adresse, Geburtsdatum, Lebenslauf, Zeugnisse, Referenzen, Versicherungsnachweise, Fernunterrichtsvertrag, Kostenübernahme, SEPA-Lastschriftmandat, hochschulrechtliche Anträge, ggf. Kündigung Ihres Fernunterrichtsvertrages sowie Bescheinigungen über den Ausschluss oder die Beendigung der Teilnahme an dem Programm. Originalurkunden (Zeugnisse, etc.) werden Ihnen nach der Verarbeitung zurückgesendet.

Im Rahmen des Fernunterrichtsangebots über das Internet einschließlich der Plagiatskontrolle, z.B. Online-Tutorials, nutzen wir verschiedene Funktionen von externen Anbietern (nachfolgend „Online-Tools“ genannt), die Ihren Namen, Angaben zu Ihren Kursen und deren Inhalt erhalten, einschließlich Aufzeichnungen Ihrer Stimme und Videoaufzeichnungen Ihrer Person. Hierbei werden Ihre personenbezogenen Daten in Länder außerhalb der europäischen Union übermittelt, insbesondere in die Vereinigten Staaten von Amerika. Die Übermittlung sichern wir vertraglich durch den Abschluss der EU Standardverträge zur Datenverarbeitung in Drittländern ab. Purpose of processing 

Your personal data will be processed for the following purposes:

• Student administration, including managing your enrolment, running the distance learning programme, issuing passes and similar documents, setting and collecting programme fees, checking attendance and absences where necessary, organising teaching (online, virtual and face-to-face), registering for and attending courses, providing and distributing teaching materials, receiving and distributing examination papers including plagiarism checks, conducting examinations and issuing examination certificates or transcripts or certificates of attendance. Other general administrative and personnel processes required for the proper running of teaching operations;

• internal audits to ensure compliance with legal, regulatory and other corporate governance obligations and internal guidelines, in the event of suspected criminal offences or misdemeanours, to uncover these, including the investigation of compliance violations.
  

Legal basis for the processing

Your personal data is processed on the basis of Art. 6 (1) b) of the General Data Protection Regulation (“GDPR”) and Section 26 of the German Federal Data Protection Act (“BDSG”) for the purpose of the distance learning contract.

Where we are required to process your personal data to comply with a legal obligation, we will do so on the basis of Art. 6 (1) c) GDPR, or in cases where we transfer your personal data to another group company or to other recipients for the legitimate interests pursued by us or a third party, we will do so on the basis of and in accordance with Art. 6 (1) f) GDPR in order to use common operational infrastructure, e.g. IT systems, or online tools for teaching and examinations, including plagiarism control.

In exceptional cases, in which the processing of your personal data is not necessary to carry out the distance learning relationship with you, but we would like to propose a corresponding processing to you, we will separately ask you for your consent according to Art. 6 (1) a) GDPR. You will then receive more detailed information in this context.

Recipients

Only those employees of the companies listed above, who are responsible for performing the activities described in the section ‘Purpose of Processing’, have access to your personal data.

In addition, our Group companies may provide IT services for us. We will gladly send you an overview of the group companies. Employees of these companies may have access to your personal data to the extent necessary for access to your personal data to the extent necessary for the fulfilment of their tasks. If you choose to pay via PayPal, payment processing will be carried out by PayPal (Europe) S.à.r.l. & Cie. S.C.A., 22-24 Boulevard Royal, 2449 Luxembourg. We transmit name, address, e-mail address, telephone and mobile number, IP address to PayPal. The data processing takes place on the basis of Art. 6 (1) lit. b) GDPR. The legal basis for the data processing is Art. 6 (1) lit. b) GDPR, as the processing of the data is necessary for the payment with PayPal and thus for the execution of the contract. The data is transferred solely for the purpose of processing the payment; the data is deleted again after delivery, insofar as our service providers are not themselves obliged to retain the data for legal reasons.

PayPal processes your personal data in accordance with the contract you have concluded with PayPal. PayPal may also pass on your data to third parties insofar as this is necessary for the fulfilment of contractual obligations or the data is to be processed on their behalf. In the context of your application and the execution of your distance learning contract, it is necessary that the IU Group processes your personal data. For the processing and administration of your data, we use various functions of external providers, namely Frankenraster GmbH and d.velop AG, who will receive knowledge of your personal data. The following categories of data may be affected by this: Name, address, telephone number, e-mail address, date of birth, curriculum vitae, certificates, references, proof of insurance, distance learning contract, cost transfer, SEPA direct debit mandate, applications under higher education law, termination of your distance learning contract if applicable, and certificates of exclusion from or termination of participation in the programme. Original documents (certificates, etc.) will be returned to you after processing.

As part of the distance learning offer via the Internet including the plagiarism control, e. g. online tutorials, we use various functions of external providers (hereinafter referred to as "online tools") that receive your name, details of your courses and their content, including recordings of your voice and video recordings of you. In the process, your personal data will be transferred to countries outside the European Union, in particular to the United States of America. We contractually secure the transfer by EU standard contracts for data processing in third countries. If you use the WhatsApp channel of the IU to communicate with us, you will receive the following information WhatsApp and IU Group employees, as well as employees of our contractual partner MessengerPeople GmbH, who manages the WhatsApp channel, have access to your personal data. Why is your personal data collected?

We need your personal data to carry out the distance learning relationship with you. You have the option of from providing your personal data or to provide us with incomplete information. However, this may mean that we are unable to distance learning relationship with you. Please note that as an internationally active company, we may not be able to international company, we have to enable our participants to participate in courses partly, sometimes exclusively, via the Internet using online tools. For this purpose, we use the services of various software providers, particularly in the United States of America or in other countries outside the European Union.
